General Terms and Conditions of Amanda Beauty GmbH and Amanda Nails GmbH (hereinafter referred to as AB/AN)
General
1. The following terms and conditions are part of the contracts concluded between AB/AN and its customers.
2. With the order, the buyer expressly agrees to these General Terms and Conditions.
3. The General Terms and Conditions also apply to all follow-up transactions, without this having to be expressly mentioned or agreed again when they are concluded.
4. All offers are non-binding. Subject to erroneous information and misprints.
Prices
1. All prices apply ex warehouse and are in Swiss francs plus packaging/shipping charges and the statutory value added tax applicable at the time of performance.
2. We reserve the right to change prices due to changed market situations.

terms of payment
1. The purchase price is due immediately when the order is placed. The customer can pay the purchase price in advance or PayPal.
packaging/shipping charges
1. The packaging and shipping costs are a flat rate of CHF 9.50. We deliver free of charge for orders with a value of CHF 290.00 or more. Delivery costs for furniture are not charged as a flat rate but effectively.
Purchase on account with partial payment option (POWERPAY)
As an external payment service provider, MF Group / POWERPAY offers the payment method “purchase on account”. With the individual invoice, you can easily pay for your online purchase by invoice. If you do not make a payment within the specified time frame, you will receive a monthly invoice with an overview of your order in the following month.
When the purchase contract is concluded, POWERPAY takes over the invoice claim and handles the corresponding payment modalities. When purchasing on account, you accept in addition to our terms and conditions,
the terms and conditions of POWERPAY. (powerpay.ch/de/agb).

You will receive the invoice free of charge by email. A valid email address is required.
delivery
1. The order is accepted subject to the ability to deliver. The buyer also accepts partial deliveries.
2. The goods are dispatched exclusively at the risk of the buyer.
3. Claims for damages, rights of withdrawal or the like can also be caused by lost or damaged goods as well as temporal
Delays as the sender cannot be claimed.
4. Transport damage must be reported immediately to the carrier and AB/AN.
5. The goods are dispatched from Monday to Friday (except on public holidays) by priority mail. (provided goods are in stock)
Subject to change
1. The descriptions and/or illustrations of the goods merely represent a non-binding product description and no guarantee of properties. The AB/AN assumes no liability for possible commercial and reasonable deviations of the goods from the catalogue/online shop.
2. We reserve the right to customary and reasonable color deviations for goods with color admixtures.

retention of title
1. The goods remain the property of AB/AN until the purchase price has been paid in full.
right of withdrawal
1. The AB/AN has the right to withdraw from the contract if the manufacturer of the ordered goods has stopped production or there are cases of force majeure, provided these circumstances only occurred after the conclusion of the contract. The customer must be informed of this immediately.
refund policy
1. Ordered and properly delivered goods can only be returned within 10 days of delivery in their original packaging, unopened and unused. Return shipping costs are the responsibility of the buyer. If the goods are returned incomplete, not in the original packaging, in the original packaging that is not in perfect condition and salable, or damaged, the AB/AN is entitled to demand compensation from the buyer for the depreciation. The right of return does not extend to damage for which the customer is responsible. All Corona protection items are excluded from the right of return.
exclusion
1. AB/AN reserves the right to exclude customers who have not paid for the ordered goods within the payment period granted from further deliveries.

privacy
1. The data required for business transactions are stored and used as part of order processing. All personal data is treated confidentially. The personal details of an order are transmitted using SSL encryption.
liability
1. AB/AN excludes any liability towards the customer to the extent permitted by law.
Governing Law, Jurisdiction
1. The legal relationships are subject to Swiss law. Exclusive place of jurisdiction for both parties is Zurich.
Severability Clause
1. The possible invalidity of individual provisions of these general terms and conditions has no influence on the validity of the remaining provisions.
With these general terms and conditions, all previous general terms and conditions as well as catalogs and price lists become invalid.

General course conditions of the Amanda Beauty GmbH Academy

Every registration is binding. The verbal or written registration obliges you to pay the course fee. Failure to pay the course fee does not count as cancellation.
Cancellation/Deregistration
Cancellations and/or postponements received up to 4 weeks before the start of the course will be charged with a fee of 15% of the course costs.
If cancellation and/or postponement does not take place at least four weeks before the start of the course, the full course costs must be paid.
Missed or missed course days, course interruptions or non-attendance do not entitle to a price reduction and/or a refund of the course fee and cannot be made up for. Not appearing on course days does not release you from paying the course costs. If the course costs are not paid, Amanda Beauty GmbH has the right to cancel your course place at short notice. The full course costs would still have to be paid in full.
certificate
After completing the training, each participant receives a certificate.
models
The course participants organize the models for practical work themselves. The absence of a model does not entitle the course to be cancelled/postponed.
changes
We reserve the right to general changes and price changes. Amanda Beauty GmbH can also postpone or cancel courses.
copyright
All correspondence and all submitted course documents are only intended for the personal use of the course participants.
Any partial or complete reproduction, duplication or copying is prohibited. All documents remain the intellectual property of Amanda Beauty GmbH.
place of jurisdiction
Exclusive place of jurisdiction for both parties is Zurich.
validity
These general course conditions apply from 01.01.2023.
With these, all previous general course conditions lose
their validity. By registering for the course, the participant accepts these general course conditions.
